NRC slaps Japanese company on California nuke work

LOS ANGELES (AP) - A Japanese company that manufactured the troubled steam generators at the San Onofre nuclear power plant might be looking for fixes with the wrong test equipment, federal regulators disclosed.

A Nuclear Regulatory Commission report found that Mitsubishi Heavy Industries failed to verify that more than 1,000 tubes being used in a generator mock-up to explore potential repairs matched specifications for tubing installed in the sidelined California generators.

Excessive wear to tubing that carries radioactive water has been at the heart of problems at San Onofre, which hasn't produced electricity since January, after the plant was abruptly shut down after a tube break released a trace of radiation.

The findings come as the agency plans to question officials from operator Southern California Edison Tuesday about the company's proposal to restart one of the hobbled twin reactors, then run it at reduced power in an attempt to stop vibration that has been damaging tubes.

The NRC said Monday a decision on that plan could come as soon as March.

Government records show the NRC issued a "notice of nonconformance" on Nov. 30 after inspectors visited a Mitsubishi plant in Kobe, Japan.

In addition to questions about the tube specifications used in tests, inspectors also found that a gauge used to measure strain on tubing was not properly certified, NRC spokesman Victor Dricks said Monday.

The agency wants the company to explain how the problems occurred and when the issues can be corrected.

The federal inspection came as Mitsubishi was preparing to use results of the testing done on the mock-up generator in other research, the report said. That raises the possibility that potentially flawed work could have been incorporated in other testing.

Earlier this year, federal officials blamed a botched computer analysis for design flaws that are largely to blame for unprecedented wear in tubes at the plant, located between San Diego and Los Angeles. They say the Mitsubishi analysis vastly misjudged how water and steam would flow in the reactors.

Southern California Edison referred questions on the Japan inspection to Mitsubishi, which had no immediate comment.

Gradual wear is common in steam generator tubing, but the rate of erosion at San Onofre startled officials because the equipment is relatively new. The generators were replaced in a $670 million overhaul and began operating in April 2010 in Unit 2 and February 2011 in Unit 3.

Overall, records show investigators found wear from friction and vibration in 15,000 places, in varying degrees, in 3,401 tubes inside the plant's four generators, two in each reactor.

The plant is owned by SCE, San Diego Gas & Electric and the city of Riverside. The Unit 1 reactor operated from 1968 to 1992, when it was shut down and dismantled.

DHS to Create a Class of *Undocumented* Permanent Resident ...

Starting on February 1, 2013, America will have a new legal class of aliens ? they will be undocumented permanent resident aliens.

This bizarre new category of immigrant was created by a notice in the December 14 Federal Register by order of United States Citizenship and Immigration Service (USCIS), a part of the Department of Homeland Security (DHS).

I discovered this startling anomaly simply by reading the fine print of the Federal Register announcement; I have seen nothing else in print about it.

These aliens will have all the rights of other legal immigrants, but they will not have the government form commonly called a green card to prove it. And it is all perfectly OK with the government. Though the term "undocumented permanent resident alien" is not mentioned as such in the publication, that is, in fact, what these aliens will be.

What USCIS has done is to announce that it will start collecting a previously authorized, but never-collected $165 fee on Department of State-cleared immigrants as they arrive in the United States on and after February 1, 2013. But unlike most government fees it is not, strictly speaking, a mandatory one. The Federal Register announcement states:

Failure to pay the USCIS Immigrant Fee will not directly result in denial of admission to the United States as an immigrant or the loss of status as an alien lawfully admitted for permanent residence. However, USCIS will not issue a Permanent Resident Card (Form I-551) to an individual who is subject to the USCIS Immigrant Fee until the individual has remitted the fee. Failure to obtain the Form I-551 will make it difficult for the individual ? to show that he or she is authorized to accept employment in the United States or to return to the United States from temporary foreign travel.

This is ridiculous. If the government is going to levy a fee on incoming immigrants and they don't pay, they simply should be stopped at the port-of-entry. But, no, DHS does not want to inconvenience any arriving immigrants by demanding payment so it has created a class of undocumented green carders.

The $165 fee (admittedly in addition to earlier ones) is a screaming bargain giving the new arrival full access to the American labor market and other valuable privileges as a legal resident of this nation.

The fee could have been collected as early as September 24, 2010, but wasn't because of a lack of coordination between the Department of State and DHS; that error has cost the U.S. Government $166,000,000 based on the government's own figures, indicating that typically 36,000 immigrants a month come from overseas, and that there was a 28-month gap between the fee's authorization and its first planned collection.

All a question of timing: When bushcrickets mate, the male attaches a sticky package, the so-called spermatophore, to the female's abdomen. Alongside the sperm themselves, this 'bridal present' consists of a protein-rich mass that the female eats after mating. It then takes several hours for the sperm to find their way into the female's reproductive tract. But, who decides when that will happen? A study by the Bielefeld biologists Professor Dr. Klaus Reinhold and Dr. Steven Ramm suggests that it is the male who determines the dynamics of this process even when he has long 'hopped off' somewhere else. They have now published their results in the online first version of the journal Behavioural Ecology and Sociobiology.

In contrast to direct sperm transfer, the use of a spermatophore could grant the female more influence over the fertilization or non-fertilization of her eggs. However, the results of the Bielefeld study cast doubt on this assumption. They suggest a high degree of male control over this decisive stage in reproduction. For their study, Professor Dr. Klaus Reinhold and Dr. Steven Ramm from Bielefeld University paired males and females from two subspecies of the bushcricket Poecilimon veluchianus in whom the time between pairing and sperm transfer differ. Whereas in the subspecies Poecilimon veluchianus minor, sperm are transferred within the first three hours, the transfer in Poecilimon veluchianus veluchianus starts only after four hours. If the two subspecies are interbred ? the researchers thought ? then the number of transferred sperm after three hours would indicate whether it is the male or the female who determines how long this transfer takes.

The researchers mated nine to twelve pairs in each of the four possible combinations of Poecilimon veluchianus minor and Poecilimon veluchianus veluchianus. Three hours after mating, they examined how many sperm they could find in the female's reproductive tract. The result: the sperm from the males of the 'faster' subspecies Poecilimon veluchianus minor could be found in the females of both subspecies. In contrast, the males in the 'slower' sub-species Poecilimon veluchianus veluchianus had transferred almost no sperm at all to either type of female.

The researchers conclude from this experiment that the males control the speed of transfer over the sperm package. However, this does not automatically lead to the conclusion that the female is powerless. Females can also influence whether sperms are transferred by how quickly they eat the spermatophore. In addition, the larger the male, the larger the size of the sperm package, and this influences how long the females need to consume the protein. As a result, the sperm have more time to transfer to the female ? and the female's eggs have a greater chance of being fertilized by a 'high-quality' male. Professor Reinhold stresses, 'Our findings show that the females do not determine the transfer ? not that they could not do so.'

Sun Life sells U.S. annuity business, shares drop

TORONTO (Reuters) - Sun Life Financial Inc will sell its U.S. annuity business for $1.35 billion to a firm connected to Guggenheim Partners in a deal that should reduce the exposure of the insurer's earnings to market swings and boost its cash levels.

While the deal could bring long-term benefits to Sun Life, whose earnings have been derailed by wild market swings during recent years, investors pulled the company's shares down by nearly 4 percent as the financial terms fell short of initial expectations.

"The stock's sort of correcting back because the deal isn't quite as big a windfall as I think the market was anticipating," said National Bank financial analyst Peter Routledge.

Delaware Life Holdings, owned by certain Guggenheim clients and shareholders, will rename itself Delaware Life Insurance Co following the cash purchase. Guggenheim will provide investment management services to the new company.

Sun Life, Canada's No. 3 insurer, said last year it would stop selling variable annuities and individual life products in the United States to focus more on group insurance and voluntary benefits.

Variable annuities - retirement products that guarantee the investor a minimum monthly payment - became a source of earnings volatility for Sun Life in the wake of the 2008 financial crisis. That is because low interest rates and Canadian accounting rules force insurers to take upfront losses on products that will not come due for years.

"The business makes money, but not enough," said Routledge.

Weak equity markets and low bond yields sent Sun Life's profit down 87.5 percent during the second quarter of 2012 and caused losses during the third and fourth quarters of 2011.

EARNINGS HIT

The deal will cut Sun Life's profit by 22 Canadian cents a share annually and reduce book value by C$950 million ($965 million), the company said in a statement. According to Thomson Reuters I/B/E/S, Sun Life was expected to earn C$2.53 a share on a net basis in 2013.

The deal has also prompted Sun Life to take a second look at its 2015 financial targets, which include a goal of C$2 billion in operating profit.

In an interview, Sun Life Chief Executive Dean Connor said he would update the market on the targets after the deal closes, which is expected during the second quarter next year.

"I'm not saying we will necessarily reduce them. I'm not saying we will necessarily leave them as they are, because we don't know yet," he said.

The deal is also expected to reduce the company's earnings sensitivity to equity markets by 50 percent and its sensitivity to interest rates by 35 percent, compared with estimates on September 30.

It will raise Sun Life's cash position to C$1.9 billion.

"Over time, we'll redeploy that cash to fund growth," said Connor. He said the growth could include acquisitions on the "smaller end of the spectrum."

Sun Life, which also owns U.S. asset manager MFS Investment Management, is targeting growth in its Asian business.

SHARES DOWN

Sun Life shares, which have outperformed its rivals with a 47 percent year-to-date rise coming into Monday's session, ended down 3.9 percent at C$26.74 on the Toronto Stock Exchange. Despite the strong rise this year, the stock still trades at less than half its all-time high set in 2007.

Robert Sedran, an analyst at CIBC World Markets, said in a research note that the earnings and book value reductions were worse than he had expected.

"Moreover, while the decline in the earnings sensitivity to market variables improves the risk-reward profile, we did not view those sensitivities as excessive to begin with," he said.

However, he said the deal will free up time and capital that would otherwise have been engaged in what is essentially a closed business, which is a positive.

Morgan Stanley & Co advised Sun Life on the transaction financials.

Law firm Debevoise & Plimpton LLP was legal adviser to Sun Life, while Skadden, Arps, Slate, Meagher & Flom advised Guggenheim Partners.

The Effect of Pre-Existing Injuries on your Personal Injury Claim

The law does not hold a person responsible for injuries that existed prior to their supposed act of negligence that led to their being liable for such damages. Said another way, if you have a ?trick knee? from an old skiing accident and one day you suffer a personal injury due to a treadmill malfunction, you can sue the gym or treadmill manufacturer for your injuries and expenses but you cannot reasonably expect to recover for a surgery to completely repair your previously injured knee. The law will only require that a defendant (or tortfeasor) compensate the plaintiff or injured party for the expenses associated with the injuries that stem directly for their act of negligence. An area within New Mexico personal injury law that the concept of exclusion of recovery for pre-existing injuries is very active is that of injuries involving soft tissue damage. It is common to have whiplash, back strain and other such soft tissue injuries in car accidents. While injuries such as broken bones are easily attributable to a specific event, soft tissue damage is far more difficult to reliably pin point as far as date of injury is concerned. If the plaintiff in such a case has a documented history of previous neck or back problems, it suddenly becomes far less clear when the specific injury to the neck or back actually took place. This creates significant ?wiggle room? for defense lawyers to attempt to minimize the damages attributed to their client. Naturally, there are varying shades of grey in this concept for attributing liability only for direct injuries caused. If, say, the plaintiff had a history of back problems but had not needed treatment of any kind for many years prior to the event in question the connection between the event and the injury is more clear. However, if the plaintiff had been seeing a doctor regularly for the months immediately preceding the event, then the causation of the back injury is put in question. Perhaps this plaintiff was injured in the car accident, but they are trying to get extra money to treat an injury they had previously suffered.? The issue of pre-existing injuries in personal injury cases can further be muddled if you consider that many people suffering from such soft tissue injuries can go long periods without feeling pain or needing treatment, only to later find that their injury had caused significant degeneration of the tissue and even greater injury, only much delayed. Even if the plaintiff had not been suffering pain or undertaking treatment immediately prior to the accident, it does not mean that they did not have such degenerative tissue problems from their previous injury, and thus, they may not be compensated for injuries to their neck or back. Because the injury pre-existed, even though it had not been treated for years, means that it was not legally ?caused? by the event and thus the plaintiff cannot recover for that soft tissue injury. It can be treated as a general truth that an injured party will not receive full, 100% compensation for damages relating to their complaint if there existed previous injuries or damage because the defendant would no longer be directly and wholly liable. The practical effect of this is that most personal injury cases that involve at least some pre-existing injuries will settle, or even be adjudicated, at a percentage of the total damages suffered by the plaintiff. (CNN) ? Since news first broke about the shooting at a Connecticut elementary school, people began wondering how something so horrible could happen.

Within a few hours, before the magnitude of the tragedy was fully known, reports began to surface that the shooter, Adam Lanza, was autistic or had Asperger?s syndrome in addition to a possible personality or anxiety disorder such as obessive-compulsive disorder.

A relative told investigators that Lanza had a form of autism, according to a law enforcement official, who spoke under condition of anonymity due to the sensitive nature of the investigation. CNN has not been able to confirm independently whether Lanza was diagnosed with autism or Asperger?s syndrome, a higher-functioning form of autism.

However, national autism organizations cautioned against speculation about a link between violence and autism or Asperger?s.

While the motive for this crime is still unknown and may never be fully understood, what is clear, according to experts, is that autism cannot be blamed.

?There is absolutely no evidence or any reliable research that suggests a linkage between autism and planned violence,? the Autism Society said in a statement. ?To imply or suggest that some linkage exists is wrong and is harmful to more than 1.5 million law-abiding, nonviolent and wonderful individuals who live with autism each day.?

Peter Bell of Autism Speaks said, ?Autism did not cause this horror.? Bell, executive vice president for programs and services for the advocacy and research group, is also the father of a son with autism.

Bell said it?s not unusual to want to figure out why someone would commit such a heinous crime, but he also cautioned people to do so responsibly.

And by definition, he said, people with a diagnosis of autism or Asperger?s are not inclined to commit an act of violence. The likelihood of this happening would be no different than the rest of the population, he added.

One in 88 children in the United States have autism, according to the latest estimates from the Centers for Disease Control and Prevention; one in 54 are boys.

Autism spectrum disorders, including Asperger?s syndrome, are a range of developmental disorders of the brain.

They can cause significant social impairments, communication problems and restricted, repetitive and stereotyped patterns of behavior.

It?s important for the public to know that the gunman?s actions can?t be linked with autism spectrum disorders, said Dr. Max Wiznitzer, a pediatric neurologist and autism expert at Rainbow Babies and Children?s Hospital in Cleveland.

?Aggression and violence in the ASD population is reactive, not preplanned and deliberate,? he said.

For example, sometimes children with autism will get violent because they are sick or frustrated and unable to communicate how they feel.

Wiznitzer also said that violence among autism spectrum disorder patients is ?sometimes due to ASD features such as desire for sameness but usually related to a co-existing disorder such as anxiety or ADHD (attention-deficit hyperactive disorder).?

What concerns advocacy groups such as Autism Speaks, the Autism Society and the Autism Research Initiative is that linking autism with violence will once again stigmatize people with autism and turn back the clock on progress made so far.

?Please do not judge any individual with autism based on what is being said about a killer of innocent children and teachers,? the Autism Society said in its statement.

Bell said he is concerned that linking autism to this crime could even endanger innocent people and that the community will begin to fear those with autism.

?We worked so hard to try (integrate them) into our communities, give them opportunities to be employees, to be able to live in our neighborhoods, and if people do jump to conclusions, we really risk taking significant steps backward for people in this population,? he said.

In a statement, Autistic Global Initiative Director Valerie Paradiz said, ?The autism community has long labored toward building understanding, awareness and trust within communities throughout the United States and the world.

?As adults with autism living productive, peaceful lives, we urge the media and professionals who participate in speculative interviews about the motives of the accused shooter to refrain from misleading comments about autism and other neurodevelopmental disabilities. ?
