University of Montana running back pleads guilty to rape

(Reuters) - One of two University of Montana football players accused of rape has pleaded guilty under a deal with prosecutors that would limit his sentence to 10 years in prison, settling a case that helped rivet attention on sexual assault among students there.

Beau Donaldson, 23, a running back for the Big Sky Conference champion team, the Grizzlies, was charged in January with raping a woman at his residence while she slept following a night of heavy drinking in September 2010.

The case was one of a spate of student-related rape reports that surfaced at the university in recent years, leading the federal government to launch a probe into the handling of sexual assault allegations by the school and local law enforcement.

The U.S. Justice Department announced in May it would examine complaints that authorities failed to aggressively pursue sexual assault and harassment reports in Missoula, citing more than 80 reported rapes there during the past three years.

Weeks later, the U.S. Education Department opened its own investigation into whether the university responded properly to at least 11 reported rapes and sexual assaults at its Missoula campus since 2010. Three of those cases involved rape accusations against members of the football team.

Only two have been criminally prosecuted so far -- Donaldson and the former quarterback and team captain Jordan Johnson, 20, who was charged in July with raping a fellow student in her bedroom in February. He has pleaded not guilty.

Both have been suspended from the team.

Football coach Robin Pflugrad, who praised Johnson's "tremendous moral fiber" in a newspaper interview after the case came to light, was himself abruptly let go from the university in March, along with Athletic Director Jim O'Day.

The scandal stunned and angered many in Missoula, a western Montana city of 86,000 whose economy and identity are intertwined with the state's flagship research institution and its alter ego, the university affectionately known as the Griz Nation.

Donaldson pleaded guilty on Tuesday to a felony count of sexual intercourse without consent, which carries a maximum sentence of life in prison. But under the terms of the plea deal, Deputy Missoula County Attorney Shaun Donovan agreed to recommend that Donaldson serve 10 years in prison.

But defense lawyer Milton Datsopoulos said he will seek a lesser sentence for a client whom he described as presenting no danger to society or to the community.

A state judge is expected to decide Donaldson's punishment in a hearing planned for November.

I just don't think this relationship is the right one for the two of you. I think a woman with as many insecurities as she has (with or without reason, not making a judgement) should NOT be in a long-distance relationship. I think YOU need to be with someone who is more open and trusting like yourself; it will make your life a LOT smoother.

Green Blog: A Red Tide Epidemic?

As we mentioned here in an On Our Radar item this week, the Yangtze River in China changed from a warm brown to a deep, rusty orange a few days ago. Striking photographs showed a ??crimson current advancing alongside a stretch of untainted water. One Green reader wrote in to describe what she saw as ?a spate of ?red tide? events around the world and inquired about the cause.

At first some scientists suspected that an algal bloom might have caused the Yangtze River to change color, but researchers now suggest that a heavy clay deposit or industrial dye was responsible. Yet ?algal blooms do seem to have caused this reddening phenomenon in several other places this year. Here?s a brief sampling.

Patches of orange and pink spread across Lake Maharlou in Iran in April; salt collectors had to wade through waters resembling a strawberry milkshake at Lake Retba in Senegal in June. The Azov Sea on the southern coast of Russia and Ukraine assumed a ?ruby-like hue in July. An intensely salty lake in Camargue, France turned red in August, as did Lake Tuz in Turkey, which is usually chalky.

The Senegalese are so accustomed to Lake Retba?s change in color that they refer to it as Lac Rose, or the Pink Lake. Which is part of the point here: these gaudy displays are fairly common. The question is whether ?they?re on the rise.

We consulted Andrew Juhl, a biological oceanographer ?at ?Lamont-Doherty Earth Observatory at Columbia University who is an expert in all things algal.

?There?s a whole spate of anecdotal reports that create the impression that something is going on,? Dr. Juhl acknowledged. But he cautioned against assuming that algae is spreading in any extraordinary way this year.

?It?s really hard to say, because in order to say whether there is a change in the frequency of blooms you have to be out sampling,? Dr. Juhl said. ?There is a reasonably good reason to believe that these blooms are more frequent and more widespread and occurring in places that they didn?t before, but it?s very hard to talk about a particular year.?

Researchers know that algal blooms have been sprouting for millenniums. Yet tracking an uptick in occurrences is difficult because no one has been sampling blooms globally for long enough, he said.

The warming of the seas as a result of climate change ?and a trend of increased salinity could be shaping blooming episodes, but for the time being the phenomenon can easily be attributed to more direct factors, Dr. Juhl said.

Fertilizer in agricultural runoff and sewage create nutrient-rich environments where algae can thrive, for example, he said, and ballast water from traveling ships takes algae on far-flung voyages, helping it to spread.

Weather events ?like the 1989 big freeze in Texas?s Laguna Madre, which killed off protozoans that prey on algae, can also help it flourish unchecked, Dr. Juhl added.

There?s even a species that craves the special circumstances created by salinity and restricted lake environments: Dunaliella salina, he said. This elliptical algae produces the pigment beta carotene, which helps the algae tolerate ?intense sun. The spread of this pigment in turn gives lakes their various hues of crimson, ?sienna and strawberry. ?It looks weird and people stay away from it,? Dr. Juhl said, but D. salina is mostly harmless to humans.

While it?s hard to judge the extent to which climate change played into this year?s events, Dr. Juhl said it was important to remember that global warming is not the only environmental negative resulting from human activity.

?The fertilization of terrestrial environments by massive application of nitrogen compounds to the earth ? that is also causing massive global change,? Dr. Juhl said. ?When you mess with those things, there will be a response.?

Sen. McCain praises ambassador killed in Libya, refuses to criticize Obama

We caught up with Sen. John McCain, R-Ariz., to talk to him about the attacks in Benghazi, Libya and Cairo. His tone could not have been more different than those of Republican presidential hopeful Mitt Romney. Firstly, McCain offered a moving tribute to Ambassador Chris Stevens, who he got to know well on his various trips to Libya. Stevens and three other Americans were killed during an assault on the American consulate in Benghazi Tuesday evening.

"Chris Stevens is one of the finest people I've ever known in my life," McCain said. "He loved the Libyan people. They loved him. He and I were down there on election night and people were saying, 'Thank You America.'"

"I guarantee you the one thing Chris Stevens did not want is for us to abandon Libya."

McCain also met Stevens in Benghazi during the Libyan revolution that ended in the death and overthrow of dictator Moammar Gadhafi.

"He was living in a hotel room in Benghazi under threat of death every day," McCain said. "He was a brave and wonderful man and he was down to earth. They loved him."

McCain, who is ranking member of the Senate armed services committee, said that Libya is a dangerous place, but emphasized that the "overwhelming majority" of Libyans voted for a moderate government and did not rise up with al Qaeda and terrorists. That is, the attacks on the consulate are an ill representation of the Libyan people.

"It was a terrorist attack. It wasn't the result of a mob being excited. It was a group of jihadists who were well-armed and well-trained and well-equipped, and they decided to attack the consulate in Benghazi and try and kill people. That's far different from what happened in Cairo, where a mob was whipped into a frenzy by these people who were talking about this so-called movie that insults Mohammed."

As for the Obama administration's handling of the crisis, McCain was almost entirely positive. "I think it was fine. By the way, Secretary of State Hilary Clinton gave a marvelous statement today," said McCain. He did not offer such praise for the Romney campaign's statements on the events.

New iPhone nears as holiday lineups unveiled

NEW YORK (AP) ? After weeks of speculation, anticipation and a dose of hype, Apple is widely expected to announce a new smartphone at an event in San Francisco on Wednesday.

Apple isn't saying anything about the topic of the event, but the email invitation it sent to reporters contains a shadow in the shape of a "5'' ? a nod to the iPhone 5. It is being held in San Francisco at Yerba Buena Center for the Arts Theater, where Apple has held many product launches.

The new model is expected to work with fourth-generation, or 4G, cellular networks. That capability is something Samsung's Galaxy S III and many other iPhone rivals already have. A bigger iPhone screen is also possible. The new model will likely go on sale in a week or two.

Apple Inc. also plans to update its phone software this fall and will ditch Google Inc.'s mapping service for its own, as a rivalry between the two companies intensifies.

In a related development, Google said Tuesday that it is releasing a new YouTube app for the iPhone and the iPad. The changes come amid the expiration of a five-year licensing agreement that had established YouTube as one of the built-in applications in Apple's mobile devices.

Still unknown is whether Apple will announce a smaller version of its iPad on Wednesday.

Apple dominates the market for tablet computers, shipping seven out of every 10 tablets worldwide in the second quarter, according to research firm IHS iSuppli. Rivals have been trying to compete by producing smaller, cheaper models ?such as Amazon's Kindle Fire. A mini iPad would challenge those relative newcomers.

Sales of Apple's iPhones are still strong, though the company lost the lead in smartphones to Samsung this year. Samsung Electronics Co. benefited from having its Galaxy S III out in the U.S. in June, while Apple was still selling an iPhone model it released last October. A new iPhone will allow Apple to recapture the attention and the revenue.

Amid expectations of a new iPhone, Amazon, Nokia and Motorola all tried to generate interest in their products last week, hoping that a head start on the buzz will translate into stronger sales. Makers of consumer electronics are refreshing their products for the holiday shopping season.

Amazon announced four new Kindle Fire models and a new line of stand-alone e-readers, while Nokia and Motorola unveiled five new smartphones between them.

Nokia and Microsoft, in particular, are trying to generate interest in a new Windows operating system out next month. The two phones announced by Nokia are among the first to run Windows Phone 8.

Here's a look at what to expect in the coming months:

? REKINDLING THE FIRE

Amazon.com Inc.'s 7-inch Kindle Fire is one of the smaller tablets with decent sales. On Friday, it will sell an updated version with a faster processor, more memory and longer battery life. It will also cut the price to $159, from $199, making it far cheaper than the iPad, which starts at $399 for the 2011 version still on sale. (The most recent ones start at $499.)

Amazon is also releasing higher-end models under the Kindle Fire HD line. A 7-inch one will go for $199, while an 8.9-inch one will go for $299. There's also a $499 model that can use the 4G cellular networks that phone companies have been building. A data plan will cost an extra $50 a year. The smaller HD model will start shipping Friday, while the larger ones will be available Nov. 20.

Amazon also refreshed its line of stand-alone e-readers, offering the Paperwhite, with its own light source. Tablets such as the iPad and the Fire don't work as well in bright light because they are lit from the back. Amazon says the light on the Paperwhite is directed down at the display.

Barnes and Noble Inc., which makes the 7-inch Nook Tablet, may have an update this fall as well.

Toys R Us, meanwhile, said Monday that it is making a 7-inch tablet aimed at children. The Tabeo will go on sale Oct. 21 for $149.99.

? MOTOROLA'S RETURN

Though it's a pioneer in the cellphone industry, Motorola hasn't had a hit since the Razr phone came out in 2004. Under new owner Google Inc., Motorola Mobility is trying to change that.

Last week, Motorola announced three new smartphones bearing the Razr name. The $99 Droid Razr M will be in Verizon Wireless stores this Thursday, the day after Apple's announcement.

Motorola will have two high-end models, the Razr HD and Razr Maxx HD, later this year. It's emphasizing long battery life ? up to 21 hours of talk time for the Maxx HD, or 10 hours of video streaming.

These are the first major products from Motorola since Google bought the company for $12.4 billion in May. Google, meanwhile, continues to sell a 7-inch Android tablet, the Nexus 7, made in partnership with AsusTek Computer Inc.

? CALLING ON WINDOWS

Microsoft Corp. will release a new version of the Windows operating system on Oct. 26, one that's designed to work on both traditional computers and tablet devices. A new version of the Windows Phone system is coming out, too.

Once-dominant phone maker Nokia Corp. has been struggling in the shadow of Apple and Android, and it's counting on the new Windows system for a revival. Last week, Nokia and Microsoft unveiled two new devices under Nokia's Lumia brand ? the 820 and the 920.

Nokia CEO Stephen Elop says the new phones will go on sale in the fourth quarter in "select markets." He didn't say what they would cost or which U.S. carriers would have them. Investors were disappointed, and Nokia's stock fell 16 percent on the day of the announcement.

Samsung, which surpassed Nokia as the world's largest maker of mobile phones in 2011 and overtook Apple in smartphones this year, showed off a Windows 8 phone late last month. It didn't announce an availability date either.

? SURFACE

Microsoft plans its own tablet computer, too. It's new territory for Microsoft, which typically leaves it to others to make devices using its software. Now, it will be competing against its partners.

The Surface tablet will come in two versions, both with 10.6-inch screens, slightly larger than the iPad's. One model will run on phone-style chips, just like the iPad, and will be sold for a similar price. A heavier, more expensive version will run on Intel chips and be capable of running standard Windows applications. The Surface will go on sale on Oct. 26.

? NEW BLACKBERRYS

A year ago Research In Motion Ltd. disclosed that it was working on a next-generation phone system for the BlackBerry, which now looks ancient next to the iPhone and Android devices. It was supposed to be out in time for this year's holiday season. That won't happen.

In June RIM pushed the release of BlackBerry 10 devices into early next year, saying it wasn't ready. That means RIM will not only compete with the new iPhone and Android devices out this fall, but it will also have to contend with the new Windows devices.

(AP) ? No one was more relieved than Sanders Commings when Georgia got through its first two games unscathed.

Now, he's ready to start doing his part.

Commings, a versatile player who can start at either cornerback or safety, has completed a two-game suspension after being charged during the offseason for domestic violence. He is eager to get back on the field for the seventh-ranked Bulldogs, who play host to Florida Atlantic on Saturday.

"It was tough," Commings said Tuesday. "But I've just been practicing hard and making sure I was ready when it was time to come back."

That time is now, and he's not the only one. Linebacker Chase Vasser has served his suspension for a DUI arrest, giving a further boost to a defensive unit that was short-handed for wins over Buffalo and Missouri.

"It feels like everything is starting to come together," nose tackle John Jenkins said. "We're starting to get our guys back."

Still unresolved is the status of two other suspended starters on defense ? All-American safety Bacarri Rambo and inside linebacker Alec Ogletree.

Coach Mark Richt has been vague about their transgressions and just how long they'll be out, though it appears Rambo's suspension will last at least two more games. The player's high school coach already revealed that Rambo had a second positive drug test for marijuana, which would result in a four-game suspension under school policy.

Ogletree reportedly was disciplined for a violation of team rules, but it's not known how long he'll be suspended.

"We'll have to wait to see for sure what happens," Richt said, repeating the line he used the first two weeks when questioned about the status of Rambo and Ogletree.

Commings, who started all 14 games last season, was just glad the Bulldogs (2-0) got through what will likely be their toughest test in the early going ? last week's trip to Missouri for the Tigers' Southeastern Conference debut. While he watched nervously back home in Athens, Georgia found itself trailing a fired-up opponent in the third quarter, only to score 24 consecutive points for a 41-20 victory.

"I would have felt pretty bad if we had lost and I could've contributed," Commings said.

While he was a bit surprised to be suspended after explaining the circumstances of his arrest to his coach, Commings said he understood that any brush with the law was likely to result in a suspension, no matter who was at fault.

There was some speculation last week that Commings would be cleared to play against Missouri, but Richt said there is no leeway for players to cut time off their suspensions through good deeds or extra work.

Commings said he did make an appeal to reduce his suspension, but indicated that school officials were concerned about setting a bad precedent ? not to mention stirring up plenty of negative reaction ? if they allowed a suspended player to come back early for a crucial game.

"If they had just flipped it at the last second, it would be like I was coming back just to ensure a win at Missouri," Commings said. "If we had done it months ago, back in the summer, it might have been different."

Defensive coordinator Todd Grantham won't say if Vasser gets to reclaim his starting job Saturday, but he does expect the versatile player to work out of multiple formations in the 3-4 defense. He is effective both rushing the passer and dropping into coverage.

Vasser is just glad he won't have to sit at home watching another game with his parents, as he did last week.

"It was a rude awakening," he said. "I've definitely learned my lesson."

No matter who plays, the Bulldogs should be solid favorites in their next two games against Florida Atlantic (1-1) and Vanderbilt (0-2). All the suspended players are likely to be back by the time they face No. 23 Tennessee (2-0) on Sept. 29.

Commings and Richt are ready to move on.

"He certainly didn't behave as he should," the coach said. "He's paying his debt to society and he paid his debt to the program. I'm glad he handled everything the way he handled it. I think he can move forward and be a real positive person and a positive teammate."

Commings is determined to stay out of trouble.

"I've learned a lot from it," he said. "I've learned I need to put myself around people who bring out the best in me."

Without those four key players, Georgia's defense didn't look its best in the first two games. Lowly Buffalo made a game of it in the first half, putting up 16 points between the hedges. Missouri burned the secondary for two long touchdown passes. Overall, the Bulldogs rank 10th in the SEC in points allowed (21.5 per game) and 11th in total defense (an average of 359 yards).

"A lot of good things happened defensively," Richt said. "But there's still things that have to be cleaned up."

He's not sure where Commings fits into the cleaning process. While cornerback is his preferred position, the Bulldogs are pleased with the play of converted receiver Malcolm Mitchell. Richt pointed out that Commings, at 6-foot-2 and 215 pounds, might be more of a fit physically at safety ? at least until Rambo returns.

"We're always going to cross-train Sanders to play both corner and safety," the coach said. "He runs really well. He also covers well. He's smart enough to play both positions."
