March 22, 2012, New York, NYAs the second anniversary of the Affordable Care Act approaches, a new Commonwealth Fund report finds that 49 states and the District of Columbia have already taken action supporting the law's implementation, such as passing legislation, issuing regulations or other guidance, or actively reviewing insurer filings. Early insurance market reforms in the law include new rules for insurers such as bans on lifetime limits on benefits and dependent coverage for young adults up to age 26.

The report, Implementing the Affordable Care Act: State Action on Early Market Reforms, by Katie Keith, Kevin W. Lucia, and Sabrina Corlette of the Georgetown University Health Policy Institute's Center on Health Insurance Reforms, is the first to assess state action on 10 early reforms, including those known collectively as the Patients' Bill of Rights, that went into effect in September 2010. The researchers found that between January 1, 2010, and January 1, 2012, 23 states and the District of Columbia had taken new legislative or regulatory action on at least one of these reforms, and an additional 26 states had taken other action to promote compliance with the reforms, such as issuing bulletins to insurers.

The reforms in the study include:

  • expanding dependent coverage for young adults up to age 26,
  • prohibiting lifetime limits on health benefits,
  • phasing out annual dollar limits on health benefits,
  • prohibiting preexisting condition exclusions for children under age 19,
  • prohibiting rescissions (cancelling insurance, except in cases of fraud or intentional misrepresentation),
  • covering preventive services without cost-sharing,
  • expanding coverage of emergency services,
  • allowing choice of primary care provider,
  • allowing choice of pediatrician, and
  • allowing access to obstetricians and gynecologists without a referral.

"In just a year and a half since these early reforms took effect, nearly all states have moved ahead on the new coverage options and consumer protections now available to their residents under the Affordable Care Act," said Sara Collins, Vice President for Affordable Health Insurance at The Commonwealth Fund. "With these actions, states across the country are taking steps to make sure that insurance carriers subject to the reform law provide American families with the new benefits guaranteed under the law."

The report finds that states took the following actions:

  • Twelve statesConnecticut, Hawaii, Iowa, Maine, Maryland, Nebraska, New York, North Carolina, North Dakota, South Dakota, Vermont, and Virginiapassed new legislation or issued new regulations that addressed all 10 of the reforms.

The authors identified a variety of reasons why states may have chosen to address only some of the early market reforms in new legislation or regulations. Some states already had existing state laws that they viewed as consistent with the Affordable Care Act; some took action only on reforms where their existing state laws were in direct conflict with the federal law.

According to the authors, states had a relatively short turnaround time to implement the early market reforms. The legislation was signed into law on March 23, 2010, and implementation of the early market reforms went into effect just six months later. The mixed approaches to implementing the reforms may also have been a result of timing issues, including such factors as: reforms going into effect after most state legislatures had adjourned for 2010; short 2011 legislative sessions; changes in the state's political environment following midterm elections; and state budget crises. Others may have been cautious given the pending decision on the constitutionality of the law by the U.S. Supreme Court.

"These findings show not only that the vast majority of states have taken action on the early market reforms but that states have adopted a range of pragmatic approaches to help ensure that their residents receive the full benefits of the consumer protections promised under the Affordable Care Act," said Keith.

Looking Ahead to 2014

States have a much longer lead time going into implementation for the 2014 reforms. But the authors caution that states may need to be more aggressive in their approaches with these reforms given that many are entirely new and do not exist in state law.

"Unlike the early market reforms, many of the 2014 reformssuch as a ban on denying insurance coverage based on preexisting conditions, and new rating requirementsdo not exist in state law. State standards may also be inconsistent with these reforms more often than with the early market reforms. Addressing these gaps will likely require states to make legislative or regulatory changes," the authors say.

Thus, to implement the 2014 reforms, states will likely have to go above and beyond the approach of reviewing insurer filings for compliance with the early reforms that some have taken. This is, in part, because states that only review insurer filings may be limited in their ability to hold insurers accountable to the new rules.

"It is encouraging that state policymakers are taking advantage of early reforms in the Affordable Care Act to improve health care coverage and access to needed health care, and provide protections for residents that are especially needed during these challenging economic times," said Commonwealth Fund President Karen Davis.

She has fully come out to herself as a lesbian, and she has even found her way into a lesbian circle of friends. She even frequents a women's night club. But she hasn't told Mom or Dad about any of this, both of whom are homophobic. Mom is particularly venomous in her hatred of gays and lesbians. You can see that Dad, a detective in the NYPD, in his heart of hearts is not a bigot. Thrown into the mix to complicate things a little bit is a bisexual girl eager to have lesbian experiences to explore herself. But she tosses lesbians aside like useless candy wrappers after she's had her fun. If I were going to give Dee Rees advice, I would say this: Ms. Rees, in "Pariah" you started digging into the parent characters with some real psychological and artistic depth. I encourage you to go more deeply in that direction. I think your true gifts as an artist lie there. I would give anything to see a sequel where you explore what happened to that mother and what she's really fighting. You hint that her husband is beginning to stray, but I think there's more in there. Help us see it. Remember when that great schoolteacher tells Alike that she could "go deeper" with her poetry? You could go deeper with your films. I know you could.

Students at the University of Rochester are upset with a professor who defended radio host Rush Limbaugh for calling Georgetown University Law student Sandra Fluke a "slut" and for suggesting Fluke should be required to post a sex tape online if someone else paid for her birth control.

Steve Landsburg, an economics professor at Rochester, said on his blog that Fluke's advocacy for having contraception covered under health insurance "deserves only to be ridiculed, mocked and jeered. To treat it with respect would be a travesty."

Landsburg said he disagreed with Limbaugh for calling Fluke a "slut," and suggested it would've been more appropriate to say "prostitute:"

[Limbaugh] wants to brand Ms. Fluke a ?slut? because, he says, she?s demanding to be paid for sex. There are two things wrong here. First, the word ?slut? connotes (to me at least) precisely the sort of joyous enthusiasm that would render payment superfluous. A far better word might have been ?prostitute? (or a five-letter synonym therefor), but that?s still wrong because Ms. Fluke is not in fact demanding to be paid for sex. (Not that there?s anything wrong with that.) She will, as I understand it, be having sex whether she gets paid or not. Her demand is to be paid. The right word for that is something much closer to ?extortionist?. Or better yet, ?extortionist with an overweening sense of entitlement." Is there a single word for that?

But whether or not he chose the right word, what I just don?t get is why the pro-respect crowd is aiming all its fire at Rush. Which is more disrespectful -- his harsh language or Sandra Fluke?s attempt to pick your pocket?

Landsburg continued to write about his disagreement with Fluke's position, calling those who agreed with her "contraception sponges" in one entry.

Outraged by his comments, 30 students protested March 7 by walking into Landsburg's classroom, dressed in black, and passing out a statement summarizing the issue from their perspective. The 30 protesters then stood between the professor and his class while he attempted to teach, and left after about 15 minutes, according to the The Rochester Democrat & Chronicle.

"We are appalled by how often women and their bodies have been used for political theatrics, and we refuse to remain passive on this issue," Kelly Rickert, a Rochester student who was a part of the protest, told The Huffington Post. "To do so would be to condone the actions of Professor Landsburg."

Landsburg ended up calling security, but the protesting students left without incident. In an email to HuffPost he said, "in their contempt for the free exchange of ideas, they appear to be comrades-in-arms of Sandra Fluke."

University of Rochester President Joel Seligman said Landsburg has the right to express his opinion, but also condemned the professor's comments.

"I am outraged that any professor would demean a student in this fashion," Seligman said in a statement. "To openly ridicule, mock, or jeer a student in this way is about the most offensive thing a professor can do. We are here to educate, to nurture, to inspire, not to engage in character assassination."

Landsburg discussed the requirement for birth control and contraception to be covered under employer-offered health insurance plans as it relates to the prevention of pregnancy. However, he failed to mention what Fluke testified about on Capitol Hill: that oral contraception is often prescribed to prevent cervical and ovarian cancer, and for the treatment of ovarian cysts. He told HuffPost that despite Fluke's testimony on birth control's benefits, such as treating ovarian cysts, "nobody believes that all good things should be subsidized and nobody believes that all good things should be covered by insurance."

"So Fluke's argument was neither an argument for subsidizing contraceptives or for mandating that insurance cover them," Landsburg went on to say. "Toothpaste also has a lot of health benefits, but it does not follow that the law should require insurers to cover the cost of toothpaste."

Landsburg insisted in a statement he sent to several news organizations that his blog posts did a better job at igniting a lively debate than Fluke's testimony to Congress. He pointed to hundreds of comments on his blog in response to his posts.

A group of Rochester students responded in a statement to HuffPost that in their opinion, what is "not up for debate is the use of violent and derogatory terms with regard to women."

Rickert posed the question, "Which is more disruptive to an educational environment in which the majority of students are women: students standing silently or a professor condoning discriminatory, misogynistic discourse?"
